GENERAL TERMS AND CONDITIONS – MICROFUSA FORMACIÓ, S.L.

1. OBJETO

The purpose of these general conditions is to regulate the relationship between MICROFUSA FORMACIÓ, S.L. (hereinafter Microfusa) and you (hereinafter the student), regarding all the transactions carried out through our online sales channel: www.escuela.microfusa.com

The property and ownership of the domain is Microfusa, a legally constituted company, with tax identification number B-63.197.099.

The student declares that he/she is of legal age and has the necessary legal capacity to contract the services offered by Microfusa, and also declares that he/she accepts to be bound by this agreement and fully understands and accepts the conditions set forth herein for using this website and for contracting the services offered.

2. RECRUITMENT

By enrolling on any of the courses offered by Microfusa (hereinafter referred to as "Course"), the student expresses the total acceptance of each and every one of the General Conditions and the data protection policy as shown on the Microfusa website even after any changes or developments that may occur in the clauses of the General Conditions thenceforth.

Microfusa has 2 contracting possibilities for its courses:

The student must duly complete the different forms which Microfusa may present during the purchase process and expressly accept the conditions applicable to the course. From the time of acceptance, you will acquire the status of a student of Microfusa, as described in these conditions. Any product or service offered by Microfusa after shall be subject to a new enrolment or purchase.

In all cases, Microfusa shall send an electronic mail to the student in which the agreed terms shall be confirmed. In the case of enrolling into a classroom course, confirmation of enrolment is subject to availability of said course. The school reserves the right to cancel a particular course, if the number of students registered at the time it was started is less than four. In this case the student will be refunded the total amount paid.

CONFIRMATION AND DOCUMENTACIÓN

Once the purchase process has been completed, Microfusa shall provide the student confirmation of such, including all the conditions applicable to the product contracted. If a transaction fails for some reason, Microfusa will notify the student. In the case that a course is reserved via the Microfusa website, confirmation will be made by e electronic mail which will include the conditions applicable to said confirmation. Whilst, in the case of reservation over the telephone, Microfusa will send the confirmation of the contract to the electronic mail provided by the student during the telephone call.

The records stored in Microfusa's digital database, or those appointed by it, will be considered as proof of communications, orders and payments which may occur between the student and Microfusa.

3. PRICES, PAYMENT METHODS, DELIVERY AND WITHDRAWAL

3.1 Payment

Microfusa offers 2 tuition payment methods to the student, although the Financed tuition payment method, is not available for all our courses:

1- Payment up-front: Cash, credit card payment, Pay-pal or bank transfer: are available directly through the www.escuela.microfusa.com website. The student will receive confirmation within 72 hours of payment via electronic mail.

2- Financed:

a. The student makes a first payment as a reservation fee paying with card, pay-pal or bank transfer through the www.escuela.microfusa.com website.

b. Instalments are then paid through the student’s bank. The student will formalize the administrative procedures involved therein, sufficiently in advance and according to requirements of the Administrative staff at Microfusa.

c. The interest rate applied to the financed part (not including the reservation nor the 1º payment) is 5 % TIN and 5,11 % TAE.

 

Purchases made through the website www.escuela.microfusa.com can be paid using the following credit cards: Visa, MasterCard, 4B, Maestro and American Express. When choosing the option of paying by credit card, bank details provided are captured and managed directly by the credit institution using the Virtual Point of Sale ("POV") and through which the payment transaction is performed. By pressing the button "pay" at the end of the payment form, the credit institution is authorised the amount of product purchased to be charged, constituting proof of the order in accordance with the laws and allowing enforceability of the amounts to be included in the purchase Order.

The POS is directly managed by a credit institution and not under the control of Microfusa. The bank details provided for payment are treated only by the credit institution and are not stored in any file of Microfusa, except in the event that the student decides to split the payment of the amount of the contracted product, in which case Microfusa will keep your bank details on the terms provided in paragraph 6 of this document in order to periodically charge the appropriate fee with prior telephone confirmation with the student, of the bank details provided..

The student agrees to satisfy any bank fee that your bank could apply due to returned bank charges, whatever the reason.

3.2 Prices

Product prices are those indicated in the commercial literature provided by Microfusa.

The final price therefore, will be shown to the student during the buying process and prior to the formalisation of acceptance by clicking "inscription".

Microfusa reserves the right to make, at any time and without notice, changes it deems appropriate and can update on a daily basis products and services. Once a course has been contracted, there will be no price variations..

If the student drops out before completion of the course and had chosen to pay in instalments, they must pay the outstanding instalments that are deemed automatically expired.

Failure to attend the course enrolled upon shall not exempt the student or their legal representatives from paying all of the agreed quotas.

3.3 Withdrawal from contract

The student has a period of fourteen (14) natural days from the execution of the purchase to terminate the contract. The student must inform Microfusa within the stipulated time and by any means allowable by law, their desire to exercise the right to terminate the contract. No amount will be refunded after this date.

In these cases, Microfusa will return the deposit paid by the student through a payment to the credit card or by bank transfer to the account specified by the student in a maximum period of thirty (30) days from the notification of withdrawal.

4. RESPONSIBILITIES MICROFUSA

Microfusa guarantees the quality of the course offered and undertakes to offer the course enrolled upon by the student, in accordance with the calendar, timetable, and conditions set out in the commercial literature, as well as to make available to the student the technical means (in classroom courses) and teachers needed for the completion of the course.

Microfusa guarantees the student’s right to attend the course enrolled upon.

Some of the degree courses have defined requirements in the records that the student must fulfil in order to guarantee their enrolment. Qualifications related links to the centres; “Southampton Solent University”, “Escola Superior de Música Jam Session”, "TileYard Education", and “Winchester University”, may be subject to proposed changes at the discretion of those institutions or government agencies.

The availability of the online store in order to facilitate the purchase of courses depends directly on the state of telecommunication systems used for its publication, and in particular the Internet. Microfusa cannot be held responsible for any interruptions, delays, errors and other problems that have their origin in causes beyond their control or their computer suppliers, among which also contain the problems arising from the software, computer systems, modems, electrical power or telecommunication networks. In these cases, Microfusa does not take responsibility of the inability to access the web site.

In case of programmed maintenance operations of the web site Microfusa will notify with an anticipation of at least 24 hours. Microfusa reserves the right to modify the content of the courses, provided that this, in the opinion of the Technical Centre's management, is in order to improve the educational effectiveness thereof.

5. RESPONSIBILITIES STUDENT

The student declares to know the contents of the course or courses contracted.

The student declares to make proper use of the Services, without infringing the law, or infringing upon the rights and interests of third parties.

The student undertakes to make lawful use of the services, without contravening current legislation or infringing the rights and interests of third parties.

The student ensures the accuracy of the data provided when filling in forms of enrolment, thereby preventing the infliction of harm to Microfusa as a result of their incorrectness.

Failure to meet any of these conditions may result in the withdrawal or cancellation of the Microfusa services without prior notice to the student, and without the right to compensation.

Failure to comply with any of these conditions may give rise to the termination of the contract by Microfusa without the need to give prior notice to the student and without entitlement to any compensation whatsoever.

Microfusa has the power to suspend the provision of the services in those cases in which it has not received full payment thereof or of any of the instalments in the case of deferred payment.

The delay in the payment of course fees in a period in excess of two weeks will result in cancellation of hours of recording studio practice and possible cancellation of tutorials/class lectures.

In case of non-payment of two consecutive or alternate monthly payments, and once the student has been asked for payment yet none is forthcoming, the early termination of contributions or outstanding monthly payment will occur, Microfusa may terminate the contract and claim the total outstanding amount.

If the student abandons the contracted course before its completion and the payment of the price has been deferred, he/she will have to pay the outstanding fees, which will automatically be understood to be due.

Non-attendance at the contracted course/s will not exempt the student or his/her legal representatives from the payment of the totality of the agreed fees.

For the duration of the contracted course, the student undertakes to communicate to Microfusa any change of address or residence made, and any change in the bank details provided, in order to maintain normal trade relations.

The contractual position of the student is personal and they cannot transfer it to a third party. The student is committed to ensuring the confidentiality of passwords that have been sent to the students’ electronic mail address. Microfusa is exempted from any liability arising from misuse or negligence by the student in fulfilling their obligation of confidentiality of their passwords. It is the responsibility of the student to properly safeguard keys and passwords supplied for their access as a registered user, preventing misuse or access by third parties.

6. INTELLECTUAL PROPERTY

Intellectual and industrial property rights over the works, trademarks, logos, and any other protectable contained in the Microfusa website belong exclusively to Microfusa or third parties who have authorized their inclusion on the website. Reproduction, distribution, marketing or transformation of such works, trademarks, logos, etc. constitutes an infringement of the intellectual and industrial rights of Microfusa or owner of the said property, and may lead to the exercise of any judicial or extrajudicial actions they may be entitled in the exercise of their rights.

Also, information to which the student to be accessed through this website may be protected by industrial, intellectual or other property rights. Microfusa is not be liable in any case and under any circumstances for violations of such rights committed as a user.

7. APPLICABLE LAW

The law applicable to this contract shall be Spanish law, the parties submitting to the Courts of Barcelona and Upper Courts that may apply.
